ALL ITEMS SELL WITHOUT GUARANTEE-- ITEMS SELL AS IS, LIKE IS,

WHERE IS, UPON BUYERS OWN JUDGEMENT. ALL SALES ARE FINAL. No Refunds or Returns. 

"Seller disclaims all warranties, expressed or implied with the respect to the goods sold hereunder, including, without limitation all implied warranties of merchantability and fitness." Purchaser agrees to indemnify and hold Merv E. Hilpipre Auction Company and Associates, and all Seller and Associates, harmless from any and all claims, damages, or losses of any kind, arising from the sale or use of the goods sold here under. Further, Purchaser agrees to indemnify and hold Merv E. Hilpipre Auction Company and Associates, and all Seller and Associates, and Webcast Providers and Associates, harmless from any and all bidders’ chosen technology devices they use for webcast bidding. Including but not limited to service disconnection, time delay, non-compliant software, unable to access, etc.”

Purchaser further agrees to pay for all purchases day of auction: Further agrees to pay a BUYERS PREMIUM of 18% for webcast purchases.



Each lot is sold by the Quantity of items per lot. Read carefully the number in the quantity section of the lot. Your bid is times the number in the quantity section. For example, if quantity is listed as “1” and your bid is $10 it means $10 x 1 = $10 for the lot (this total bid is prior to the applied buyers’ premium of 18%. The buyers’ premium will be added to your total when you are invoiced). If quantity is listed more than “1” for example qty. of 2 and your bid is $10 it means $10 x 2 total bid for the lot would be $20, (this total bid is prior to the applied buyers’ premium of 18%. The buyers’ premium will be added to your total when you are invoiced).

All descriptions, machine specifications and serial numbers, etc., are believed to be correct but are used only as a guide and are not guaranteed.

Announcements made day of auction supersede previous announcements.


GENERAL TERMS & CONDITIONS OF SALE
1. The Auctioneer will announce whether the auction is with or without reserve. All rights of the auctioneer and the purchaser shall be in force depending on the type of auction. Announcements made during the sale supersede any previous announcements whether spoken or printed. Any persons selling or consigning items to the sale shall not bid on said items or is not allowed to have an associate or agent bid for them.

2. Any person desiring to procure any and all bids shall register with the Auction Co. Registering will consist of providing all necessary information asked by the Auction Co. All person registering guarantee provided information to be accurate and warrants that he is authorized to bid on behalf of the firm or party represented. Auctioneers or Auction Co. reserve the right to refuse any applicant a bidding card and may revoke such privilege at any time.

3. All purchases must be settled in full the day of the sale and shall be removed from the premises within the time specified by the auctioneer. Payment shall be in the form of cash, cashier checks, credit cards which will have an additional fee, or checks. Checks must be accompanied by a bank letter of credit guaranteeing the check. Auctioneers or Auction Co. will have the sole right to determine if a person does not need to provide a letter of credit or if payment may be delayed. By bidding on items in the auction buyer represents to Auctioneers that he is financially solvent and all checks issued by buyer will be honored. A dishonored check is conclusive buyer insolvent and entitles auctioneer to remedies available under applicable laws.

4. All goods will be put in lots and will be sold to the highest bidder for cash. The record kept by the clerk of sale together with the marked catalog of the Auctioneer shall in all cases be accepted by the buyers as final when questions arise as to the price for which lots have been sold.

5. Auctioneers reserve the sole right to change the order of the sale, the size of the lots, the addition or subtraction of a lot number. Auctioneers will have the sole right to determine the bidding increment. In the event of a buyers’ dispute or tie bid, the Auctioneer has the sole right to either open up the bidding for continued advancement or strike the goods sold. Auctioneers reserve the right to refuse any bid which they consider to be insignificant advance over the preceding bid.

6. Any errors in accounting toward purchasers bill will be corrected according to the actual facts. Purchaser agrees to pay what is owed. Purchaser shall not be entitled to possession of any of his purchases until total purchase price of all his items have been paid in full. In the event purchaser fails to pay the full purchase price of any lot within the prescribed time or fails to compile with any terms of sale Auctioneers shall have retained a possessory lien on all lots of purchaser and at their sole discretion have the right to resell such lots by public or private sale without notice of any kind to purchaser.

7. Any printed literature given to purchasers such as a buyers catalog shall only act as a guide. If Auctioneers express opinion to condition or merchantability, and what price should be paid. No sale shall be invalidated by reason of any defect or inaccuracy in any of the lots by reason of their being inaccurately described in this listing catalog or elsewhere, no liability shall be born by Auctioneer in the respect of any such faults or errors.

8. Purchaser acknowledges and agrees that all good have been available prior to sale time and that he is purchasing all goods with all defects. DO NOT BID UNLESS YOU HAVE DETERMINED TO THE CONDITION OF TO THE LOT FROM YOUR OWN EXAMINATION. Buyer acknowledges sole responsibility and assumes the risk that a lot after it has been inspected might change. Auctioneer will sell lot(s) as it exists at time sold, as is, where is, with no warranties whether implied or expressed. Any and all warranties or guarantees will be between the buyer and seller only.

8. The auction sale sight shall include any location which a lot is located for display and or removal as well as where the actual bid calling in conducted. Auction sales site are considered potentially dangerous places and immediately upon registration if not before purchaser shall so notify agents, servants, and employees and others accompanying him.

9. All claims or disputes must be settled on the day of the sale at the sale site. No claims will be allowed after the removal of goods.

10. Appropriate taxes will apply. Tax exemptions accepted if purchaser produces proper documentation of their exemptions.

REMOVAL TERMS
1. Purchaser will be responsible for complete removal of all goods purchased. Cost of removal will be the responsibility of the purchaser.

2. Auctioneer reserves the right to require proof of adequate insurance coverage from any buyer of lots requiring dismantling, rigging, or hot cutting.

3. Any damage caused to real property or other goods caused by the purchaser or his agents, the purchaser agrees to cover all damages both to the property and legal. Purchaser agrees to indemnify and hold harmless the Auction Co., Auctioneers, their agents, any and all sellers from and against any damage to property or injury to person or loss of life occasioned directly by the act or acts of buyer or buyer’s representative, agent, or employees in connection with the dismantling or removal of any lot or any other action resulting from the attendance of the purchaser to this sale.

4. In the event that the purchaser fails to remove any such lot or part thereof within said period, the Auctioneer or his designees shall have the right but shall be under no obligation to do so either in the name if the Auctioneer or other seller or the purchaser to remove, store, abandon, discard, sell or otherwise dispose of each of any part of lot bid in or purchased at the expense and risk of the purchaser without waiving any other rights that the auctioneer or other seller may have against the purchaser.

5. The purchaser shall be and shall continue to be liable for all lose, expense, and damage directly sustained by the auctioneer or seller by reason of the failure of the purchaser to comply with the foregoing condition.

Beginning the week of May 4th - Week days, Monday to Friday: 9:00 am to 4:00 pm.
Also, Saturday, May 9th: 9:00 am to 3:00 pm.

Payment Information
REGISTRATION INFORMATION:
No registrations permitted for those located out of the USA.
AND
No registrations accepted from residents of the states of California and New York.

Animal Head mounts to be sold to Iowans only.

PAYMENT INFORMATION:
TERMS: Everything sells like is, as is, where is. No warranties or guarantees are in effect whether expressed or implied. All Sales Final. No refunds or returns.

PAYMENT: US FUNDS ONLY - Cash, Wire Transfer, ACH, or Cashier Check. NO CREDIT CARDS ACCEPTED. NO CHECKS.

Buyers Premium of 18% applies on all purchases.

Also, an FFL handling fee of $40 per firearm applies.

All purchase payments must be received no later than TUESDAY, MAY 18, 2020 by 2:00 pm.

All In-person payments must be made only at the facility of Hilpipre Auction Co. 2862 Wagner Rd, Waterloo, IA 50703.

All shipping charges to be fully paid by the purchaser prior to the shipping of the purchases. These will be a separate payment from the purchase invoice. (See the shipping instructions).

PROCEDURES FOR INVOICING
1. Please read carefully.
a. Successful buyers will receive an invoice sent to their registered email address. Please make sure you have “Trusted email address from Proxibid.com and sue@hilpipre.com” selected in your email portal settings.
b. NO INVOICES will be sent until the auction is fully completed.
1. The invoices will be emailed sometime after 3:00 pm CST of Saturday, May 16, 2020.
2. AGAIN - NO INVOICES can be created during the auction on Saturday, May 16, 2020.
c. Your invoice will include: A list of each lot purchased along with the purchased amounts, the buyers’ premium, firearms handling fee, and the balance due for purchases.

FIREARM PURCHASER additional REQUIREMENTS
All State Laws are in effect.

Firearm Purchasers to follow these additional procedures:
Once purchaser has followed the payment procedures, the following additional procedures will take place for firearm purchases.
1. After purchaser receives their invoice, please follow the auction company payment procedures.
2. All firearms FFL paperwork will be processed ONLY from the Auction Company FFL dealer, (Brian Davison dba Davison Gun Shop).
a. FOR SHIPMENTS: NO firearms to be shipped to an individual. Firearm purchases will only be shipped to a FFL dealer.
b. For Pickup: Fully read all required steps to scheduling a pickup appointment. NO firearms will be allowed to be picked up without a scheduled appointment.
3. Purchaser provides further completed documents: Email to sue@hilpipre.com or in-person at Hilpipre Auction Co.
a. Completed FFL documents.
b. Also, if firearms are to be shipped, the FFL purchaser’s provider must prepare a letter on their letterhead, stating they are aware and are willing to receive and distribute the firearm purchase/s to the named purchaser.
i. List the purchasers name, address, bidding number, lot number/s and description of the purchased firearms they will be receiving and distributing.
c. Provide a copy of purchaser driver’s license.
d. The completed Pickup/Shipment Request form.
4. Auction Co. will provide the purchaser’s FFL documents to Davison Gun Shop.
5. Davison Gun Shop will process the paperwork, prepare the firearms for pickup or shipment, and ship the purchases per the directions of completed shipment request form.
6. REMINDER: No firearm purchaser will be allowed to “pickup” their purchased firearms at time of payment, must schedule an appointment. Davidson Gun Shop will only ship firearms to another FFL Dealer.
a. No attendance to Davison Gun Shop during the auction and after the auction has concluded.

 
Checkout Information
Buyer assumes all risk of loss at the time of the item is sold. The relationship between the Auction Co. and buyer is not bailment. All Merchandise is sold as is! Where is! No warranties are in effect!! NO REFUNDS!!

Remove all items per the directed removal dates.


FOR IN PERSON ATTENDANCE TO OUR FACILITY. To pay and / or pickup
DUE TO FEDERAL COVID-19 regulations of social distancing and other Federal, State, and Local regulations: For entrance into the facilities, we will only allow one purchaser at a time. Please adhere to these procedures. There will be restrictions on entrance into the building. Including but limited to: All must wear a mask or other like face covering.

1. There will be NO ONE allowed in the auction company facility nor Davidson Gun Shop on Saturday, May 16. Closed on Sunday, May 17.

2. ON MONDAY, MAY 18: All purchasers must call OR email to inform what form of payment they will be using and how auction company will receive their payment.

3. If purchaser desires to PAY In-person, An appointment MUST be Scheduled. To Schedule call or email. PHONE: 319-235-6007 or email: sue@hilpipre.com

4. The dates and time available to make an In-Person payment will be Mon., May 18: 8:00 am to 4:00 pm. AND Tuesday, May 19: 8:00 am to 4:00 pm. BY APPOINTMENT ONLY. If you arrive without an appointment, you will not be allowed in until the next available day and time. DO NOT arrive without a scheduled appointment.

5. The purchaser and/or person who is paying and/or picking up the items MUST PRESENT their driver’s license and sign the attendance form.

IF YOU CHOOSE IN PERSON: To make a payment and pickup please adhere to these procedures.
1. Payment to be made only at Hilpipre Auction Co. facility. Located at 2862 Wagner Rd., Waterloo, Iowa.
2. The appointment must be made scheduled in advance of arriving to our facility. Please call or email to schedule an appointment on Monday, May 18 by 2:00 pm.

4. DO NOT ARRIVE without a scheduled appointment. You will not be allowed in the facility.

6. Purchaser to present driver’s license and if purchased firearms please also present your FFL.
a. We will make necessary copies.
7. NO IN PERSON ATTENDANCE for payments and/or pickups accepted on Saturday, May 16 OR Sunday, May 17, 2020.
8. REMINDER: Schedule your appointment on Monday, May 18 by 2:00 pm. We will begin accepting IN PERSON payments and pickup, BY APPOINTMENT ONLY on:
a. Monday, May 18: 8:00 am to 4:00 pm
b. Tuesday, May 19: 8:00 am to 4:00 pm
9. All payments and pickups of animal mounts must be finalized by 5:00 pm Tuesday, May 19, 2020.
10. If you arrive without a scheduled appointment, you will not be allowed in. You will have to schedule an appointment and return on the scheduled day and time.

When arriving to our facility of Hilpipre Auction Co. – 2862 Wagner Rd, Waterloo, IA 50703
1. Park on the south of the building. Do not enter building without permission.
2. Stay in your car and call our phone number – 319-235-6007.
a. We will let you know if you can enter the facility or if you need to wait in your vehicle. Purchaser is limited to one additional person to help remove their purchases. If more are needed further arrangements must be made prior to arriving to facility.
3. Once allowed to enter the building you will come to the window to make payment and/or receive your paid invoice.
4. All attendees to present their drivers’ license and sign the payment/pickup form.
5. Once payment is made please immediately pickup your purchases animal mounts and/or hides.
6. We need to keep on schedule as much as possible.
7. REPEATING: BY SCHEDULED APPOINTMENT ONLY:
a. All IN-person payments to be made only at Hilpipre Auction Co.
b. PICKUP of THE ANIMAL HEAD MOUNTS and Hides to be ONLY picked up at Hilpipre Auction Co., 2862 Wagner Rd., Waterloo, IA.
c. PICKUP AND/OR SHIPMENT FOR THE FIREARMS: to be picked up or shipped from the FFL Dealer of Davison Gun Shop, 1638 275th St., Janesville, IA.

e. NoOne arrives to either facility without a scheduled appointment.
 
Removal Information
DUE TO FEDERAL COVID-19 regulations of social distancing and other Federal, State, and Local regulations: For entrance into the facility, we will only allow one purchaser at a time. Pickup dates: Mon., May 18 and Tues., May 19: 8:00 am to 4:00 pm.
All Head mounts and hides must be removed by Tuesday, May 19 by 5:00 pm. NO Sunday payments or pickups.

If you arrive without an appointment, you will not be allowed in until the next available day and time. DO NOT arrive without a scheduled appointment.

NOTE: When the FFL dealer, Brian Davison, gives Hilpipre Auction notice of his completed paperwork.  Purchasers may personally pickup or may have the firearm/s shipped. A Pickup / Shipment form must be completed. No pickup or shipment to be done until all procedures are completed. See the Firearm procedures in the payment info section.  Contact Auction Co. for questions.

FOR ANYONE REQUESTING SHIPPING of FIREARMS:
The following further terms and conditions will apply.
1. Purchaser must fill out the shipping form.
2. Purchaser is responsible for arranging pickup and payment via their preferred carrier.
a. Purchaser is solely responsible for all fees associated with the carrier charges.
b. Purchaser to send the shipping label to auction company.
3. Preparing items, by auction co., for shipping there will be a $15 per lot handling fee.
a. Additional fees assessed for special requests. Ie: crating/skidding, strapping, extra packing material, etc.

4. All related fees must be paid for via Wire transfer or ACH prior to the shipment being sent.
